The terms defined below shall have the following meaning in these terms and conditions:
“We” / “Click2Refund”: Click2Refund Inc., Canada HQ Office: 1 King Street West, Suite 4800-200, Toronto, ON, M5H 1A1 — who will assert your claim for compensation.
“You” / “Client”: Person(s) that has accepted these Terms.
“Agreement”: Agreement between the Client and Click2Refund reached after acceptance of these Terms and signing the Certificate of Authority.
“Claim”: Any monetary compensation claim against an airline based on laws or regulations regarding delayed, cancelled or overbooked flights.
“Certificate of Authority”: A document authorizing Click2Refund to act on behalf of the Client.
“Retainer Agreement”: Document stating that the Client retains Click2Refund and accepts the terms for legal services.
“Compensation”: The total monetary amount paid by an airline to Click2Refund or the Client after acceptance of these Terms.
“Legal Action”: Handing over a claim to a contracted lawyer or filing a claim with a court/government body.
“EU Regulation 261/2004”: Regulation setting common rules on compensation for passengers.
We assert your claim for compensation according to EU 261/2004 or any applicable air passenger rights regulation.
By entering into the agreement, you confirm you have the legal capacity to do so.
You warrant that the claim has not been assigned to third parties and no legal dispute with the airline is ongoing in the same matter.
You must provide all required data and ensure it is correct and truthful. Fraudulent or incorrect data gives us the right to terminate the agreement without compensation.
Your personal data is used only to pursue your claim and may be transferred to third parties only when necessary for legal processing or compliance.
You may submit information via website, email, phone, or supported software. Once evaluated and accepted, you will be asked to sign the Certificate of Authority.
After signing the Certificate of Authority, you may not assign or engage any other party to pursue the claim.
You must forward any direct communications from the airline to us and refrain from negotiating independently.
Upon receipt of the Certificate of Authority, we contact the airline and manage all further communication.
If the airline does not pay compensation within a reasonable period, and if the case is strong, we may initiate legal action.
You authorize us to share your information with contracted lawyers. Additional documents required by courts must be signed by you.
In extended legal cases, Click2Refund may deduct legal fees from compensation where applicable.
If legal action is taken and lost, Click2Refund covers all costs.
When the case is won or settled, legal fees may be deducted unless paid by the airline.
We take 29% of the compensation (plus taxes). Fees may vary under special partner agreements.
You authorize us and contracted lawyers to conclude settlement agreements when needed. Offers below 80% or vouchers may be rejected without consulting you.
You must inform us immediately if the airline pays you directly. These payments still count as “compensation” and fees apply.
We are not liable for lost checks, wrong bank information, or wrong addresses provided by you.
No interest can be claimed for the period between incoming and outgoing payments.
Electronic invoice available upon request.
Payments are processed via bank transfer or PayPal. Transfer fees are deducted from compensation.
Airlines may pay in different currencies. Conversion uses Click2Refund’s bank reference rate.
You may withdraw from the agreement within 14 days unless the claim has already been submitted to the airline.
We may terminate the agreement if obligations are violated or if the claim is later deemed unpromising.
Terms may be updated anytime. Negative changes do not apply retroactively.
Invalid provisions do not affect the validity of remaining terms.
These terms are governed by the laws of Ontario, Canada. Small Claims Court, Ontario has jurisdiction.
