Air Passenger Rights at Cancún International Airport

If your flight from Cancún International Airport to or from the European Union is delayed or cancelled, you may be entitled to compensation under EU Regulation 261/2004 (EC 261). This regulation protects passengers travelling on flights operated by EU airlines or departing from an EU airport to Cancún. For flights departing from Cancún, EC 261 applies if your airline is headquartered in the EU.

Under EC 261, you could claim compensation if your flight is delayed by more than 3 hours, cancelled without prior notice, or if you are denied boarding due to overbooking. The compensation amount depends on the flight distance:

      • Up to 1,500 km: €250 per passenger
      • 1,500 km to 3,500 km: €400 per passenger
      • Over 3,500 km (most flights between Cancún and Europe): €600 per passenger

Even if your flight is operated by a non-EU carrier, you may still be eligible for compensation if your journey originated in an EU country. For flights from Cancún to the EU, EC 261 compensation applies only if the airline is based in the EU.

Typical cases include flight delays exceeding 3 hours, flight cancellations within 14 days of departure, and denied boarding due to overbooking. Airlines are also required to provide care such as meals, refreshments, and accommodation when necessary.
