Air Passenger Rights: Delays, Cancellations & Compensation

If you experience a flight delay or cancellation with Thai AirAsia, you may be entitled to compensation under certain circumstances. For flights departing from an EU country, or for flights to the EU operated by an EU-based airline, the EU Regulation 261/2004 (commonly known as EU 261 or EC 261) protects your rights as a passenger. However, since Thai AirAsia is not an EU-based airline, EC 261 applies only to flights that depart from an EU airport. If your Thai AirAsia flight originates outside the EU, EC 261 compensation rules do not apply.

Under EC 261, if your flight is delayed by more than 3 hours upon arrival, or if your flight is cancelled less than 14 days before departure, you may be eligible for financial compensation. The compensation amounts depend on the flight distance:

      • For flights up to 1,500 km: €250 per passenger
      • For flights between 1,500 km and 3,500 km: €400 per passenger
      • For flights over 3,500 km: €600 per passenger

Compensation is not provided if the delay or cancellation was caused by extraordinary circumstances, such as severe weather or air traffic control strikes. If you are entitled to compensation, you can claim not only for delayed or cancelled flights but also for denied boarding due to overbooking. Remember, your rights to meals, refreshments, accommodation, and communication assistance are also protected under EC 261 during significant delays.
