Air Passenger Rights: Delays, Cancellations, and Compensation

If your Ethiopian Airlines flight has been delayed or cancelled, you may be entitled to compensation under EU Regulation 261/2004 (EC 261), depending on your route. This regulation protects air passengers traveling from airports within the European Union, regardless of the airline, or on flights operated by EU-based airlines arriving in the EU. While Ethiopian Airlines is not an EU carrier, EC 261 applies if your flight departs from an EU airport.

Under EC 261, you could claim compensation if your flight is delayed for more than 3 hours upon arrival, cancelled without adequate notice, or if you are denied boarding due to overbooking. The compensation amount depends on the flight distance:

      • For flights up to 1,500 km: €250 per passenger
      • For flights between 1,500 km and 3,500 km: €400 per passenger
      • For flights over 3,500 km: €600 per passenger

These rights apply when your Ethiopian Airlines flight originates from an EU country. If your journey starts outside the EU and is operated by a non-EU airline (like Ethiopian Airlines), EC 261 does not apply. However, if your flight departs from an EU airport, you are fully protected by EU 261/EC 261 and can claim compensation for eligible delays, cancellations, or denied boarding.

Compensation is not due if the delay or cancellation is caused by extraordinary circumstances, such as severe weather or air traffic control strikes, outside the airline’s control. For eligible cases, passengers are also entitled to care, including meals, refreshments, and accommodation if necessary.

Your Rights to Compensation with Ethiopian Airlines

If you have experienced a delayed or cancelled Ethiopian Airlines flight departing from the EU, you may be eligible for compensation. According to EU 261/EC 261, the amount you can claim depends on the distance of your flight and the length of the delay. For example, if your flight was over 3,500 km and you arrived more than three hours late, you could be entitled to up to €600 per person. Ethiopian Airlines must also provide care and assistance during long delays, such as refreshments, meals, and hotel accommodation if needed.

Always keep your flight documents, boarding passes, and records of communications with the airline. These will help you support your claim and ensure you receive the compensation you deserve.
