If your LOT Polish Airlines flight is delayed or cancelled, you may be entitled to compensation under EU Regulation 261/2004 (EC 261). This regulation applies to flights departing from any airport within the European Union (EU), as well as flights operated by LOT Polish Airlines from outside the EU to the EU, since LOT is an EU-based carrier. Compensation is not dependent on your citizenship but on the flight route and airline’s country of registration.
Under EU 261, passengers have rights to care (such as meals, refreshments, and accommodation) during delays of more than two hours, and the right to reimbursement or re-routing after significant delays or cancellations. If your flight is delayed by more than 3 hours on arrival, cancelled less than 14 days before departure, or you are denied boarding due to overbooking, you may be eligible for financial compensation, unless the disruption was caused by extraordinary circumstances (such as severe weather or air traffic control strikes).
To claim compensation, your flight must have departed from an EU airport, or arrived in the EU on an EU-based airline such as LOT Polish Airlines. For example, a flight from Warsaw to New York, or New York to Warsaw with LOT would be covered, but a flight from New York to Warsaw with a non-EU carrier would not.
Compensation claims are valid for delays, cancellations, or denied boarding not caused by extraordinary circumstances. You have the right to request written information about your rights from the airline at the airport.
