Air Passenger Rights – Delays and Cancellations Compensation

As a passenger flying with Avianca, you are entitled to certain rights in case your flight is delayed or cancelled. Under the EU Regulation 261/2004 (EC 261), travelers are protected when their flight departs from an EU airport, or when arriving at an EU airport on a European carrier. If your Avianca flight originates within the European Union, or if you are flying into the EU on an Avianca-operated route, you may be eligible for compensation in the event of significant delays, cancellations, or denied boarding.

According to EC 261, compensation amounts are determined by the distance of your flight and the length of delay at your final destination. For flights up to 1,500 kilometers, compensation can reach €250 per passenger. For flights between 1,500 and 3,500 kilometers, you may claim up to €400. For flights over 3,500 kilometers, compensation can be as high as €600 per person. It is important to note that compensation eligibility depends on the circumstances of the delay or cancellation and whether the disruption was within the airline’s control.

If your Avianca flight was delayed by more than three hours, cancelled with short notice, or you were denied boarding, you have the right to claim compensation under EU 261, provided your journey meets the regulation's criteria. The regulation applies if your flight originated within the EU, or if you arrived in the EU on an EU-based carrier. For non-EU airlines like Avianca, EU261 applies only to flights departing from an EU airport. Compensation is not applicable for flights into the EU from outside, unless operated by an EU carrier.

Compensation claims are also supported if you experienced missed connections due to earlier delays, resulting in a total delay of three hours or more at your final destination. In addition to financial compensation, passengers are entitled to care and assistance, such as meals, refreshments, and accommodation, depending on the delay duration.
