Air Passenger Rights & Compensation for Delays and Cancellations

As an Air India passenger, you have important rights in the event of flight delays, cancellations, or denied boarding, especially for flights covered by European regulations such as EU 261/2004 (also known as EC 261). If your Air India flight departs from an airport within the European Union (EU), Iceland, Norway, or Switzerland, or if it arrives in the EU on an Air India flight from a non-EU country, you may be eligible for compensation under EU 261.

Under EU 261, compensation amounts are determined based on the distance of your flight and the length of the delay at your final destination. You may be entitled to:

      • €250 per passenger for flights up to 1,500 km
      • €400 per passenger for flights between 1,500 km and 3,500 km
      • €600 per passenger for flights over 3,500 km

Compensation is typically available if your flight was delayed by more than three hours, cancelled without sufficient notice, or you were denied boarding due to overbooking. However, extraordinary circumstances such as severe weather or air traffic control strikes may exempt the airline from compensation obligations.

To qualify under EU 261, your journey must either originate from an EU airport or be operated by an EU-based airline arriving in the EU. Since Air India is a non-EU carrier, compensation applies only when your flight departs from an EU airport. If your Air India flight originates outside the EU and arrives in the EU, EU 261 compensation rules do not apply.

If your flight is delayed or cancelled, you also have the right to care, including meals, refreshments, and hotel accommodation if necessary. Always retain your travel documents and record your communications with the airline to support your claim.
